FoINI Considered that the Information Commission Performance is Poor

Celebrating Right to Know Day (September 28th, 2014) Freedom of Information Network Indonesia (FoINI) expresses disappointment at the performance of Information Commission 2013-2017 period. FoINI assessed that Information Commission has perform badly, even potentially inhibit the openness climate. Rofik Ahmad, spokesman of FoINI stated that Information Commission is supposed to be the guardian and guarantor of the civil rights to information has become public threat.

“Commission information in some districts and local governments have misguided in interpreting the Law Civil Organizations which establishes the registered certificate from National and Political Unity (Kesbangpol) as formal requirement request of information dispute”

“The incumbent of Information Commission in districts encourages the Implementation Guidelines (Juklak) and Technical Guidelines (Juknis) on information commission selection that considers re-appointment without going through the selection process”

Hendrik Rosdinar, other member of FoINI also upset with the results of the National Coordination Meeting (Rakornas) of Information Commission in the past mid-September. “Rakornas not succeeded in formulating strategic matters. But instead produce things that flirtatious in my opinion. For example, the making of Information Commission mars. According to information I received, Rakornas actually produce things that are counterproductive. There is friction in the internal of Information Commission related to judicial review,” said Hendrik upset.

“Information Commission of Pontianak has more than a year stalled in the selection process at the House of Representative. Provincial Information Commission still has not been formed in the 4 provinces remaining. It has been four years since UU KIP enforced. PATTIRO had filed suit over the denial of requests for information by the Supreme Audit Board (BPK) in November 2013. Until now there has been no follow up from Information Commission. In some areas, the demand for information on the district budget, DPA and RKA were rejected. There is no any response from Information Commission”

FoINI asked to Information Commission to fix their performance. Especially to address the matters that mention above. Information Commission is also required to publish to the public all the budget that has been used by Information Commission. In particular budget of Rakornas implementation.

Gedung-DPR-RI-1Jakarta, March 26­th – Parliament currently has rules about the implementation of Law No. 14 of 2008 on Public Information, that is the Parliament Regulation No.1 of 2010 on Public Information in the Parliament of the Republic of Indonesia . However, these regulations haven’t been effective to encourage public participation in making process of the policy in the House of Representative. This was revealed by researcher of Indonesian Parliamentary Centre, Arbain .

Arbain adding that openness is the other side that should be provided to push our public participation. “During this time, public got the information about Parliament policy discussion from the media. It was only partial. Though people need whole information, in order to provide the right input” added Arbain.

Therefore, Arbain suggested the Parliament to have information system that is up to date, giving full information and clear chronology. “Parliament website can be used as good tool. At least its reach through cities that has internet access facility in every electoral district” he added. However, the offline-based information systems also need to be developed to reach all constituencies.

Jakarta (March 24th) – The effectiveness of parliamentary work can be achieved through simplification of Political Parties. However, the thing that also needs to be improved is the openness of faction. So that constituents can access and know the performance of faction. The statement was made by Ronald Rofiandri in discussions “For More Effective Parliament” in Jakarta. Ronald is also a researcher at Centre for the Study of Law and Policy, he said that in the currently new revised of Draft Law of MD3 is an effort to eliminate the faction accountability to constituents. “It would be counterproductive to the purpose of faction strengthening itself “, he continued.

On the other hand, Arwani Thomafi, Member of the special committee Draft Law of MD3 said that openness is not just for the faction, but also overall to the parliament. “I think Fraction occupied a central position in parliament, due to embody constituent needs. Therefore, they should be open” he explained.

The issue of strengthening faction was raised along with the rise of establishment of the simple party system in parliament. Simple party system is interpreted with little fragmentation concerns in Parliament so that make them faster in decision-making and did not take long-winded. However, the strengthening of this faction should also be accompanied with accountability of the members. Researchers Indonesian Parliamentary Centre (IPC), Hanafi said that despite the faction is strong, the openness and accountability at the level of members should also be given space, in order to balance between delegate function and trustee functions members of Parliament.[]

Tangerang (24/10) –  Laporan Hasil Pemeriksaan (LHP) keuangan negara berposisi penting sebagai pijakan dalam merencanakan anggaran dan pengawasan keuangan negara. Sebagai bentuk tindaklanjut terhadap hasil audit, Badan Pemeriksa Keuangan (BPK) setiap tahun rutin menyerahkan LHP kepada DPR sebagai lembaga perwakilan. Meski demikian, LHP tersebut tetap perlu dibuka kepada publik. Karena, bagaimanapun kewenangan pengawasan di lembaga perwakilan tanpa ada partisipasi publik bisa jadi tumpul atau sebaliknya, tajam tapi untuk kepentingan pribadi/golongan.

Pendapat tersebut disampaikan oleh Arif Nur Alam, Direktur Indonesia Budget Center (IBC) dalam menanggapi Revisi Undang-Undang Nomor 15 tahun 2006 tentang BPK. Dalam draft tersebut, hanya ada kewajiban BPK untuk menyampaikan LHP kepada badan publik teraudit dan lembaga perwakilan, baik DPR, DPD dan DPRD. “Seharusnya BPK tetap mempublikasikan hasil audit tersebut kepada publik melalui website. Karena itu uang negara, uang rakyat,” jelas Arif.

Arif menyayangkan BPK saat ini yang tidak mempublikasikan LHP, terutama setelah LHP diserahkan kepada DPR. Padahal BPK periode terdahulu sudah berinisiatif untuk mempublikasikan di website BPK. “Kekhawatiran menyalahgunakan informasi LHP ini tidak bisa diterima. Karena, hak tindaklanjut kan ada di badan perwakilan. Sementara masyarakat menyampaikan aspirasinya kepada badan perwakilan tersebut,” jelasnya.

Selain publikasi via wesbite, Arif juga memandang perlu penguatan Badan Kehormatan Kode Etik (BKKE BPK) di permanenkan dan menerima aduan dari publik. Karena, belakangan ini banyak daerah yang mendapat predikat audit Wajar Tanpa Pengecualian (WTP) akan tetapi tidak bekerja dengan baik pada sektor pelayanan publik. “Ada indikasi status WTP ini jadi “mainan” untuk ajang pencitraan para kepala daerah. Tapi, kemana masyarakat harus mengadu atas masalah ini? Masyarakat butuh saluran. Auditor juga manusia” pungkas Arif.  [AH]

Catatan Untuk Seleksi Komisi Informasi Pusat 2013-2017

Proses seleksi Komisi Informasi Periode 2013-2017 telah berakhir. Berdasarkan Uji Kelayakan dan Kepatutan (Fit & Proper Test) yang dilakukan Komisi I DPR RI akhirnya terpilih tujuh orang nama, diantaranya Abdulhamid Dipopramono, Dyah Aryani Prastyastuti, Evy Trisulo Dianasari, Henny S Widyaningsih, John Fresly (wakil pemerintah), Rumadi (wakil pemerintah) dan Yhannu Setyawan.

Menurut pengamatan Koalisi FOINI terhadap proses seleksi di Pansel hingga pemilihan di DPR, kami menilai terdapat situasi bernuansa ketertutupan yang menciderai semangat keterbukaan, diantaranya; Pertama, Kementerian Informasi dan Informatika (Kominfo) tidak pernah mengumumkan 21 nama calon hasil seleksi tahap akhir yang dilakukan Pansel Komisi Informasi kepada Publik.

Kedua, Presiden melakukan pengabaian karena terlambat menyerahkan 21 nama calon ke DPR hingga batas akhir masa jabatan Komisi Informasi Pusat 2009-2013 berakhir. Keterlambatan ini menyebabkan kasus-kasus sengketa informasi yang ditangani Komisi Informasi Pusat terbengkalai.

Ketiga, Proses Pemilihan calon Komisi Informasi Periode 2013-2017 dilakukan secara tertutup. Berdasarkan pengamatan terhadap pemilihan oleh Komisi I DPR RI yang dilakukan melalui mekanisme musyawarah dan mufakat, Koalisi FOINI menyesalkan proses tersebut yang tertutup. Dan tanpa menjelaskan pertimbangan alasan-alasanatas lolos dan tidaknya setiap kandidat, sehingga menjadi anggota Komisi Informasi Pusat.

Kami menilai pemilihan yang seolah-olah dibungkus musyawarah dan mufakat sebenarnya tak lebih dari memilih kucing dalam karung yang berlandaskan kepentingan elit partai semata tanpa mempertimbangkan kapasitas, kredibilitas dan integritas para kandidat.

Kemudian terlepas dari itu, dari tujuh kandidat terpilih ternyata lebih banyak didominasi “orang baru”. Meskipun beberapa terdapat beberapa wakil dari Komisi Informasi Daerah, namun belum teruji pengalaman dan kinerjanya dalam mengatasi persoalan ketertutupan informasi di daerah. Sehingga diperkirakan Komisi Informasi Pusat akan beranjak dari titik nol kembali.Minimnya anggota Komisioner yang berpengalaman dalam penyelesaian sengketa informasi dan penguatan kelembagaan sistem pengelolaan dan pelayanan informasi publik menjadi tantangan berat dalam menjalankan KIP periode ini.

Berbagai tantangan lain yang akan dihadapi oleh Komisi Informasi Pusat ke depan, diantaranya: meningkatnya trend sengketa informasi publik, pembentukan Komisi Informasi Provinsi, dan momen politik Pemilu 2014. Menatap berbagai tantangan tersebut, perlu kiranya Komisi Informasi Pusat periode 2013-2017 untuk segera melakukan konsolidasi dan merumuskan road map untuk empat tahun ke depan.
