Jakarta,- Information Commission of West Kalimantan has been established on August 21st, 2014. The establishment is based on the announcement letter No. 162/139/DPRD-D on August 21st, 2014. Kebebasaninformasi.org received the news by electronic mail from the researcher of Indonesian Center for Environmental Law (ICEL), Dessy Eko Prayitno on Friday, August 22nd, 2014.

Start from confusing of people at Desa Waipangali Kabupaten Sumba Barat Daya (SBD) Provinsi NTT on the way to access the information about Jamkesmas (Jaminan Kesehatan Masyarakat) and Jamkesda (Jaminan Kesehatan Daerah); finally Chief of Local Posyandu, Kristina Ladi, accompanied by her partner Martha Kalaka visits the Health Department (Dinkes) of SBD on October 23rd, 2013 to deliver a letter which contains the request to get information about anything that related to procedure of Jamkesmas/Jamkesda arrangement for their villagers.
But until November, 2013, that letter was not responded by SBD Health Department, armed with the knowledge on mechanism that shown on Law No. 14 of 2008 which now popular as Law of Public Information Openness (KIP), Kristina sent the objection letter that directed to the District Secretary (Sekda) SBD.
The point of KIP Law is obligating all public institution that its purposes involved with state enforcement and operational which is funded partially or fully by APBN and or APBD obliged to open up to deliver the information to public with some exception for information which potentially harm the state security and Health Ministry (Kemenkes) RI via SBD Health Department should give the information bout Jamkesmas/Jamkesda/Jaminan Kesehatan Nasional (JKN) that requested by Kristina.
The action of Kristina got a special appreciation from SBD District Secretary, Tony Umbu Zaza on declaration of Forum Perempuan Rahimku event on December, 2013 that attended by arround 70 women activists that comes from village, NGO, State Departments Staff, and other institution within the scope of SBD District Government (Pemkab). On his speech, Tony shows his shock when accepted objection letter from 2 women of Weepangali Village, at time he was happy, because the people is begun to know on their right over public information. They even brave send the objection letter when request of their information is not responded by related department. Tony also emphasize so that the people can ask the information that required with mechanisms which has been regulated KIP Laws.
But in reality, it was not as smooth as oration from the official. On January 2014, one of the member of Kristina family was positively diagnosed suffering from Leukeumia after did the check up at RS Karitas –SBD several times. The hospitals recommends the patients to take treatments at Denpasar Hospital. Because they don’t have money, Kristina called the SBD Head Department to attempt Jamkesmas or other recommendation letter that can ease the medical expenses.
Day after submission of Head of Department called Kristina to prepare the administrative completeness to arrange the Jamkesmas that immediately compliance, but until a week later there is no followed up from SBD Health Department. Kristina continues her attempt by visiting Social Security Administering Agency (BPJS) SBD to search the information procedure of JKN arrangement. Unfortunately, according to BPJS official who was met by Kristina, JKN arrangement needs a long time and can’t immediately directed to hospitals outside NTT Province. Finally with her own expense and helped by family donation, NGO, and financial support from District government; Kristina can send off his sister to receiving treatment at Denpasar. But fate ran another course, after took treatments Kristina’s sister has passed away on February, 2014.
Reflecting on her experienced, Kristina thought that she needs to request the complete information on JKN arrangement to SBD Health Department. So, on April 4th, 2014 accompanied by Agustinus (her fellow Weepangali Village and Facilitator of People Empowerment Pattiro), Kristina submit the letter of information requests to Head of Health PPID (Information and Documentation Management Officer), in this case it was Health Department Secretary. After they accepted at Head of PPID office who responses their requests nicely, and give appreciation on those initiative who have helped government duties. He also mentioned the objection letter that have been submitted by Kristina and Martha on November, 2013 and stated that he had sent the responses but Kristina stated she did not receive the letter intended.
When they talked, Head of Health Department enter the room to submit the CD that contains information about JKN to staff of FPM Pattiro along stated that disposition of letter that directed to Head of Health Services Division had already made but the official who responsible are being outside, so Kristina and friends was requested to came again on another opportunity. Kristina has satisfied enough with responses that been given by SBD Health Department which assessed friendly and responsive by him on giving document that requested. Next day, Kristina with her partner Martha determined to spread the information around JKN arrangement to all level of society so that they can access health facility that becomes those rights as Indonesian citizen.

On Tuesday, April 10th, 2012 at 02.30 PM i go to the Unimed Public Relation, precisely on first floor of Administration Building, to deliver the first letter of information request.
I entered the room and asked the staff: ”Is this the Public Relation Office?”
They said: “Yes.”
Later on, i gave the letter to one of the staff at that office.
When i give the letter, they asked me: “where do you come from?”
“I am the student of Unimed, Faculty of MIPA Ma’am”, i answered.
Then they read my letter, they said: “Next time, if you wanna make letter that directed to Unimed Public Relation, the redaction it should be like this: To the Honorable. Head of Unimed Public Relation, not the Head of Public Relation Bureau, because every bureau had a public relation”.
Then i said, “So how with this ma’am, Should i change it?”
Then he said: “It’s okay. But next time if you makes letter to Unimed. It has to be as said before.”
“Yes, ma’am”, i said.
Afterwards she gives that letter to another staff. When he accepted, i gives the letter expedition to be signed by him. He signed it. After i accepted the expedition letter, i said thanks to him and left.
April 11th
Then the next day, April 11th, 2012 around 03.00 PM, i was called via phone someone who confessed his self as Dean Staff of FMIPA Unimed.
He said: “Is this James Ambarita, the Head of GMKI FMIPA Unimed?”
“Yes, Sir. Who is this?” i asked.
“I am the Dean Staff of FMIPA Unimed, tomorrow at 9 AM, the Dean has invited you to come to the office. Can you?”
Then i answered, “Yes, Sir. I can.”
April 12th
On Tuesday April 12th, 2012 at 09.30 AM i have arrived at Dean of FMIPA Office, i saw the Dean in front of the door.
Then i greet him and said, “I am James Ambarita, Sir.”
Afterwards the Dean told me to enter his room, and i did. The Dean also told me to sit.
The Dean made a conversation, he said, “I have surprised, when i read your letter that directed to Unimed Public Relation. Vice Rector III has name Ambarita, you are Ambarita, your secretary are Sirait, i am Sirait. We had same family name.”
He continued, “What semester are you?”
I said “Twelve, Sir”
Dean: “Why don’t graduated yet?”
I said, “I have ever took furlough, so i will take long studies.”
When the Dean continues the conversation, suddenly the Vice Dean III, Head of Mathematics Department and the former Dean entered the room. I stand up and greet them.
The Dean said: “Now i wanna talk to you first James Ambarita. I will speak as your guardian here. Assumes me as your father. I don’t wanna arguing with you about the letter you have made. I listen the news from the top that there are FMIPA Student that made the information request. After i know it was you, i called you here. Please try to think, in a whole family, are the child is worth to asking to the parents about family business? For example like output and family input. I think it is not worthy. Like as you have made, i thought, it was not worthed”.
Then Vice Dean III said: “Now i will ask you first, what your purpose with it?”
I have answered, “On that letter was so cleared, it written our purpose?”
The Vice Dean III is asking again: “It was not what i meant, what i mean is what do you purpose to makes this letter? Are you ask for scholarship from rector, or what? If you want that, i think you were wrong, because when you re-registration as students in 2011, you are reporting there is an illegal fees at FMIPA, on that moment you as if close to the rector but now you have made this letter to against the rector.”
I silent without answering.
Then the Former Dean said, “Long time ago when i was a student, i used to be officiated as the Head of GMKI Commissariat of FMIPA, what i was done on that time is followed up the member, not doing something like you did.”
Then Head Department of Mathematics said: “What you have done is the methods of NGO, it was not students. Now i ask you first, for example if your information requests have been accepted, then what would you do about that?”
I have answered: “If we accepted that information , it may add to our knowledge, at least we used to be know the financial report from a university, who knows if between us will focus to work in project development later. So, we can learn about it now.”
Then Mr. Vice Dean III said while holding the copy of that letter: “When i have accepted this letter, I showed it directly to the former of GMKI FMIPA that were graduated. They are shamed to read this letter, they are silent. So, actually you have been humiliated your organization with the letter you have wrote. You have been humiliated your seniors.”
Then i said: “why should i be ashamed? Or Should i ask you first all? Am i wrong if i make this letter? If you could show my mistakes, i will pull this letter and won’t go forward.”
On that time, i said it and then The Former Dean leave the room, in that room just 4 people left.
Then Mr. Vice Dean III said: “I think your letter was wrong, the purpose of your letter is not for Unimed Public Relation, but it is for Education Ministry. The contents of your letter is also have not an ethics, you forces Unimed Public Relation to reply your letter within 10 days.”
Then Mr. Dean said: “Never mind, it is too many advice that been given by the guardian in this faculty, yes, as your guardian here, i expect you to listen our advice, but if you don’t want, that is up to you. Now, i wanna ask you, will you continues these letter? I think, until here this letter will end, let me take care of this to the rectorat that this letter will not continue. It is better if you take care of your thesis so that you can graduate as soon as possible, i can feel what your parents feel in there village.”
Then Mr. Vice Dean III said: “We have given many advice, that is good if you listen and doing it, but if you still want to continue this letter, of course there is consequences that will faces you.”
After i listen the Vice Dean III talked, i said directly to him: “I think we should end this conversation, i apologize because our meeting can be obstruction for all on doing activities. Honestly, i am proud can discuss with Mr. Dean, Vice Dean and Head of Department. Okay, Sir. I know that all of you have a lot of work, excuse me, sir.”

On Wednesday, April 25th 2012, I delivered the objection letter with my friend to Unimed Rectorat. We entered the the office, i gave that letter without asking about letter that i accepted and wrote the receipt. After i signed, we exit the office.
On thursday Mei 1st 2012, the secretary of GMKI FMIPA-UNIMED sent me sms that asking “Am i invited to the office of FMIPA Dean to meet him tomorrow”. I answered, “Nothing, this afternoon i have been invited to meet the Dean, in that time my phone was left in my boarding house. But there is 2 missed call from Vice Dean 3, perhaps it means to invite me to the Dean Office” i said.
Then the secretary replied my sms, he said,”we have been ordered to meet the Dean tomorrow at 9 AM, you probably ask about that letter.”I replied immediately, “Oh my god, i can’t go tomorrow, i have to pick up my brother at Polonia Airport.”
Next day around1 PM, my secretary sent me sms which content is persuade me to meet and discuss about that letter after i finished my study. Around 6 PM, he came to PGI Sumut, we discussed bout it. He said, “We should stop it, if the information requests is given to us, then what should we do”? I answered immediately, “Why should we stop, there is nothing wrong with that, we just ask that and it is our right, and it’s been regulated by the laws. If the information that we’ve requested is given by Unimed, then it’s nice. When we accepted that, it will be new insight to us. We will know how much budget in Unimed financial reports.
The he said, “If you wanna know only, we better stopped, because earlier i have been called by the Head of Department, He said that he just need one day to know me, and i am not necessary know him within 3 years, we have to stopped it”.
Then i said, “i have said yesterday, if you called by the Dean or the Head of Department involved that letter, just said that you know it, you’re only as the letter administrator that issued it, if they ask the amount, tell us that i am in full charge with it. That’s what you have to say, so that you will not get involved with it.”
Then i said again, “We have no fear, they just threatened me, I have been experienced with this before”.
Then he said, “My solution is you should back down, chief, on Friday we will finish it with the Dean”.
I answered, “I will never back down, on Friday we will meet the Dean”.
On Friday Mei 4th, 2012 07.45 AM, I go to the college, On the way go, i meet the secretary, i rode the motorcycle with him. We go to college together. Before i meet the Dean, we discuss for a moment, he said, “We better back down, Chief”.
Then i said, “It is up to you, if you wanna back down, just do it, i understand that you will be pushed in this faculty. Okay, just tell them later that you will back down, but i would never”.
Then both of us go to the Dean office.
At 08.15 AM we have arrived at Dean office. We met the Dean in his room and we greet him. After we entered the room, then Vice Dean 3, Head of Mathematics Department, Head of Mathematics Study Program, Head of Physics Study Program, Head of Physical Education Study Program and Academics Lecturer, Mula Sirait (Secretary of GMKI FMIPA-UNIMED) entered the room. We greet them too.
After we are welcome to sit, Vice Dean 3 ask permission to the Dean immediately and he start the conversation,”We are here on the orders by the Supervisors of University to talk about that you have been wrote. Here are the disposition from Rector” (While showing the disposition letter along the attachment that we have made). Then the Vice Dean 3 said,”After i read the objection letter which you addressed to the rector, my political instinct came alive, you James, is not smart that i thought, i am sure there is someone behind you. If you forward this letter, there will be a risk that you must face, if you still assume us as your parents, you should stop it, but if you not assume me as your parents, we will take affirmative action.”
Then the Head of Mathematics Department said, “I will salute when you did this from the deep of your heart, not because there someone else behind you. For me it shows how fool you are, you are willing to be used by other. In the end, you will be the victims. If you forward this, then do it, we had a rules and laws here. If you ask about the budget, i think it was unethical.”
Then the Vice Dean 3 said, “You should assume that you are not attended, it should be marked by you. It between the parents and the child. We still do the persuasive action. If you still stubborn, perhaps we will do what we have to do. You James, i knew who is behind you.
Then the Dean said, “i feel creeps when hears the students vow, it has been ashamed the almamater.”
Then the Vice Dean 3 said, “I have analyzed it with my friends, i already know what you are goal, but it is up to you. If i have been disturbed, i will track your position. I will sure there is no added time for you to finish your study, and i sure that you can’t finish your proposal and thesis, this day is the stipulation, it is not a threat, everybody is already angry.
Then i said, “Can i talk to you sir”?
They said, “It is your pleasant”.
Then i continues the conversation, “In making this letter, it were pure from ourselves, no ones behind us. If you can shows who is behind us, and if it for sure and can be responsible by you, then we are ready to pull out this, just said that now sir, whom people behind us”.
Then the Dean said, “Never mind, yesterday i thought our meeting is alredy finished, but in fact you are forward this letter. I will collect our professors from this faculty, i will make the faculty senate to talking about you James Ambarita. We will give the decisive action to you”.
Then the Vice Dean 3 answered,”I think you are over confident, i know who is behind you, including the place you have met, but it impossible to me to shows here. If i said here it can expose his disgrace. We better talk eye to eye, i will tell you whom people behind. So, you better not to plade”.
Then the Vice Dean 3 said, “i have told you, you are not as smart as i thought,”.
Then Head of Mathematics Department said, “I have assumed that thing which be charged will not be reached. The goal that their reached is conveyed that public information, and it will not be reached because it do not have the way”.
Then the Dean said, “Public definition by them were not cleared, Does GMKI is an NGO. If they not registered at KESBANGLINMAS, it can be reported, because they make restlessness, there are public definiton told that not all of information can’t be given”.
Then Head of Mathematics Department said, “So, i think they only a victims, and we became busy to solve this”.
And Head of Physics Education Study Program said,”I thought they go to Unimed to study, you have to think about your parents, i will only adivised that anyone who did something then he will bear the consequences, although they carrying the name of GMKI and eventhough you do this from you heart, in the end you will be the victims, if i were your mother, i will cry when my child doing this.”
After the Head of Physics Department invited us to continues the conversation at his room.
At 10.15 AM, we moved out and greet them. We left the Dean room and heading to Head of Physics Department. His room is above the Dean office, we entered and start the discussion. He is talk more about his stories. We just listened him.
One of his stories: “There is a father who had two son and one daughter. They request a razor. The first and second son are given the razor, but the daughter does not, because the first son had a bushy mustache and should be shaven and the second son had a long beard, the daughter have not had mustache and beard to be shaven so she does not given.”
Then he continues, “So the recent history is same as you ask.”
After i heard his story, we have been ordered to answer his questions, he said, “Are you’ll continues it, you have ever said that, Mula”? Then Mula answered, “I think, i will back down from it, Sir”. Then he asked me, “How with you, James, are you’ll continues?”
I said,”Give me three days to consider, because if i answer now, i still in pressure, Sir. So give me three days, Sir. On Monday i will give the answer”.
Then Head of Physics Departement said, ”Okay, I will forward this to the Dean.” After it we permit to leave. At 11.45 AM we left the Head of Physics Department Room. (James Ambarita/AA)

Pusat Sumber Daya Buruh Migran (PSD-BM) bersama Serikat Buruh Migran Indonesia (SBMI) di Malang, Wonosobo, dan Indramayu, LAKPESDAM NU Cilacap, Infest Yogyakarta, Paguyuban Buruh Migran dan Perempuan Seruni Banyumas, Serikat Paguyuban Petani Qoryah Thoyyibah (SPPQT) Salatiga, LBH Yogyakarta, dan Jingga Media Cirebon, sejak 26 Januari 2013 telah merancang gerakan permintaan informasi publik. Bagaimana proses dan hasilnya, berikut Wawancara kami dengan Fathulloh, Pegiat Pusat Sumber Daya Buruh Migran.
Gerakan permintaan informasi oleh buruh migran ini berlangsung massif. Selain di Indonesia, di luar negeri juga?
Ya, di luar negeri juga. Tenaga Kerja Indonesia (TKI) di Hong Kong yang tergabung dalam Tim 11 juga meminta hak informasi dengan cara mendatangi dan mengirim surat kepada badan-badan publik.
Organisasi-organisasi tenaga kerja Indonesia di Hongkong yang melakukan permintaan informasi ini, apa saja?
Ada Asosiasi Tenaga Kerja Indonesia (ATKI), Indonesian Migrant Workers Union (IMWU), Persatuan BMI Tolak Overcharging (PILAR), dan Liga Pekerja Migran Indonesia (LIPMI). Selain itu juga jejaring organisasi TKI di Hong Kong .
Informasi apa yang diminta?
Ada 150 lebih jenis permintaan informasi telah dikirim ke badan-badan publik seperti Kemeterian Tenaga Kerja dan Transmigrasi (Kemenakertrans) dan unit kerja turunannya di daerah, Badan Nasional Penempatan dan Perlindungan Tenaga Kerja Indonesia (BNP2TKI) dan unit kerja turunannya di daerah, Kementerian Luar Negeri (Kemlu), Dirjen Imigrasi, dan Konsulat Jenderal Republik Indonesia (KJRI) Hong Kong. Intinya terkait tata kelola penempatan dan perlindungan TKI. Sejak Terhitung hingga Mei 2013 lalu.
Apakah badan publik tersebut memberikan tanggapan yang cukup baik?
Ya, beragamlah. Mayoritas memang belum memberikan tanggapan. Sebagian ada yang memberikan respon. Misalnya, BNP2TKI, PPID-nya berupaya memberikan beberapa dokumen yang diminta. Kemenkumham juga meneruskan surat permintaan informasi tentang pencekalan TKI kepada Dirjen Imigrasi dan beberapa hari kemudian Dirjen Imigrasi membalas.
Yang tidak memberikan tanggapan, lembaga mana?
Kemenakertrans dan KJRI Hong Kong.
Kemenakertrans lama baru ngasih respon. Kami masukkan surat dari Februari, tapi Mei 2013 baru ada jawaban dari Kemenakertrans.Nah, yang parah. KJRI Hong Kong. Mereka mengabaikan. Tak ada balasan sama sekali. Bahkan surat keberatan yang sudah dikirim sejak 7 April 2013 pun diabaikan.
Sikap ini, mencerminkan mutu pelayanan KJRI Hongkong?

Ya, jika informasi yang diminta aja diabaikan, apalagi terhadap informasi yang wajib disediakan?
Apa langkah selanjutnya?
Pertama, kami sudah mengajukan gugatan. Akan ada sidang gugatan jarak jauh, antara kami dan KJRI Hongkong, itu janji KI Pusat. Kedua, kami akan terus mensosialisasikan UU KIP kepada buruh migran. Banyak dari mereka yang terabaikan haknya karena minimnya informasi. Gerakan minta informasi ini, perlu dimassifkan.

Awal permasalahan yaitu tahun 2011, di awal perkuliahan di semester 5, UTS, kami mengalami perubahan sistem ujian dari tadinya secara manual essay test menjadi online. Sewaktu manual itu, ujian kami adalah essay test. tapi setelah online itu menjadi multiple choice. Saya tidak setuju dengan metode ujian secara multiple choice, karena saya adalah mahasiswa Fakultas Hukum (FH). Seharusnya tes di FH itu, bagaimana meneliti sebuah kasus dan penyelesaiannya, bukan diperlukan multiple choice, itu kurang cocok.
Dalam UU No. 14 tahun 2005 tentang Guru dan Dosen, yang mempunyai wewenang untuk menguji setelah pemberi materi. Di dalam pasal 51 huruf (e) dan (f), disebutkan bahwa dosen diberi kuasa oleh UU untuk menilai serta memberi kelulusan. Setelah tahu itu saya pun komplain dan menghadap ke dosen. Dosen melanjutkan ke Kapolri dan kemudian Kapolri melanjutkan ke Wakil Rektor 1. Kasus ini ditanggapi. Saya disuruh memilih 2 model ujian, yaitu essay test dan multiple choice online.
Alasan Otonomi Kampus
Akhirnya, mahasiswa FH diberikan ujian secara essay test. Pada saat ujian, pengawas mengatakan kepada saya saat mengabsen, “Nampat Silangit, apapun hasil ujian kamu tidak akan ada artinya. “Wah jangan begitu Bu, tapi kalau mau begitu, silakanlah. Itu salah!” kata saya. Kami melanjutkan ujian. Pukul 14.00 WIB, hasil ujian keluar secara online. “Nilai saya jelek!” Saya print out, saya konfirmasi kepada dosen-dosen mata kuliah tersebut, apakah ini nilai mata kuliah saya?
Dosen bilang, “Kami belum pernah memberikan nilai kepada Anda dan sampai saat ini kami tidak pernah melihat lembar ujian dan lembar jawaban Anda.” Karena ini melanggar UU, Saya sarankan dosen tersebut ke Kapolri dan ke Rektor. Tapi Rektor mengatakan itu otonomi kampus.
Karena itu otonomi kampus, saya minta mimbar FH. Sebelum ke mimbar, saya pastikan lagi UU no. 14 tahun 2005 ini. Saya pun ke Kejari dan di arahkan ke 5 Jaksa. Jaksa di situ mengatakan, “Kami ini pembohong besar! Tidak ada satupun universitas dari Sabang sampai Merauke seperti itu. Bila yang kamu katakan benar, lapor ke kepolisian!”
Mimbar FH
Esok harinya, saya kembali ke kampus menghadiri mimbar FH, yang dihadiri Wakil Rektor I dari Universitas Putra Batam (UPB), dari STMI Pak Toni Wangra. Karena saya adalah wakil universitas, pada saat giliran Saya, Saya bertanya ke Pak Toni Wangra, “Maaf Pak, selama saya ketahui Rektor saya adalah Pak Adijoyo, jadi Bapak ini sebagai apa di kampus ini?” Beliau bilang “Saya ini Wakil Rektor 3 bidang IT.” Sementara di UPB itu tidak ada Wakil Rektor 3 dan saya sudah memfotokopi struktur organisasi UPB. Pak Toni mengatakan itu otonomi kampus. Bila tidak terima, saya dipersilakan melapor ke Kejaksaan, ke Polisi, dan akan ditunjukkan alamat-alamatnya.
Saya tahu bahwa universitas swasta itu di bawah oleh Kopertis, saya pun menghadap ke Kopertis wilayah 10 di Padang. Saya menghadap ke Direktur Bidang Kemahasiswaan. Saya diminta membuat pelaporan ini tertulis. Saya diminta berpikir lagi terhadap tindakan saya karena ini akan berbahaya untuk kampus.
Lalu saya kembali ke Batam dan saya persiapkan laporan tertulisnya. Tapi setelah saya buat laporan tertulisnya, tidak satupun surat laporan saya ditanggapi oleh Kopertis wilayah 10 Padang. Surat-surat tersebut memiliki nomor surat dan surat bukti tanda terima surat ada di saya.
Kemudian saya juga melapor ke Polda Kepri sebagaimana sudah dijelaskan proses hukumnya oleh Jaksa. Setelah melapor dan di-BAP, penyidik diarahkan ke Kompolres, unit 6 bagian Tipiter. Ketika saya datang, di-BAP, dan saya diminta untuk melengkapi alat bukti. Setelah saya lengkapi apa yang mereka minta, saya kemudian justru mulai dipersalahkan dan saya malah disuruh untuk mempersiapkan seluruh alat bukti.
Saya katakan bahwa UU memberikan wewenang kepada penyidik untuk bisa mengambil seluruh bukti ke kampus. Tapi saya katakan kalau memang demikian, saya siap, saya tahu jalur yang akan saya tempuh.
Menggunakan UU KIP
Oleh karena itu saya pakai UU 14 / 2008 dan saya ajukan permohonan ke UPB, 10 hari kemudian juga tidak ditanggapi, setelah itu saya ajukan keberatan dan 30 hari kemudian juga tdak ada tanggapan. lalu saya ajukan ke KI Kepri untuk proses penyelesaian sengketa informasi.
Hari pertama ajudikasi, pihak UPB tidak hadir, itu tanggal 18. Tanggal 19, saya disidang di UPB oleh beberapa Dekan dan Kapolri, saya di tanya dan tidak diberi kesempatan untuk membela diri. Tanggal 23 saya terima surat bahwa saya sudah di DO, jadi 3 mahasiswa di DO, dan 7 orang di skorsing selama 2 semester. Alasannya karena kami melanggar statuta UPB dan merongrong nama baik UPB.
Setelah itu berlanjut persidangan di KI, UPB tidak mengakui bahwa mereka badan publik. Mereka menyatakan tidak punya sengketa dengan saya. Setelah itu pembuktian berkas-berkas, KI Kepri membuat putusan yang memenangkan kami. Setelah 14 hari saya tunggu, tidak ada respon dari UPB, rupanya UPB banding ke PN.
Banding Ke PN
Hari pertama pemeriksaan berkas, hari kedua diarahkan ke mediasi 1, 2, 3. Saya bingung kenapa ada mediasi karena mediasi adanya di KI. Karena diulur-ulur, saya lalu menghadap ke Ketua Majelis.
Ketika itu KI Prov mengadakan seminar, pembicaranya dari Hakim Agung yaitu Bpk Supandi yang mempresentasikan tentang Peraturan MA dan saya mendapat pemahaman dari situ. Setelah itu saya menghadap ke Ketua Majelis, saya bilang bahwa saya sudah bertemu dengan Hakim Agung, Pak Supandi dan ini sudah tidak sesuai dengan Peraturan MA (PerMA), saya juga berikan fotokopiannya. Pada tanggal 7 sidang pembuktian, PerMA lagi-lagi tidak dipakai. Pembuktian dari UPB semua diterima, tetapi pembuktian dari saya tidak diterima padahal saya berikan putusan KI dan foto lembar ujian yang saya dapatkan dari Polisi.
Hakim mengatakan kepada saya, bukan ini, mana aslinya? Saya sudah bilang bahwa asli dan sudah dileges oleh PP KI, artinya ini sudah sama dengan aslinya. Tapi hakim tidak menerima itu dan bersikeras untuk saya memberikan aslinya. Saya katakan bila memang begitu, akan saya siapkan.
Saya kemudian telepon Pak Arifuddin Jalal, Komisioner KI Kepri. Beliau bilang, menurut PerMA, saya tidak ada wewenang untuk mengambil Surat Putusan KI yang asli di KI.
Tanggal 8 November, saya menghadap ke ketua PN. Saya bawa media 3 orang, dan ketua PN mengatakan kepada saya, apa masalah saya. Saya sampaikan ke dia dan rupanya ketua PN sudah mengetahui permasalahan saya. Setelah itu hakim mengatakan kepada saya, kita akan suruh PN untuk memintanya (surat putusan KI yang asli). Tapi saya bilang bahwa saya akan menindaklanjuti ini ke Komisi Yudisial (KY) atas PerMA yang sudah dilanggar.
Kini, saya butuh dukungan teman-teman FoI-NI. Dukungan inilah yang membuat saya bangkit lagi. Padahal, semula saya sempat ingin menyerah. Memperjuangkan nilai ujian sama beratnya dengan memperjuangkan nilai transparansi.
