FOINI Sues Gorontalo Governor Regarding KI Gorontalo Appointment

Jakarta – (19/11) The Freedom of Information Network Indonesia (FOINI) on November 9, 2015, filed a lawsuit at the Manado Administrative Court following the issuance of Gorontalo Gubernatorial Decree No. 323/11/VIII/2015 about Re-appointment of Gorontalo Information Commission (KI) Period 2015-2019.

In the lawsuit, FOINI requested the court to urge the Gorontalo government to revoke the decree and conduct another selection of Gorontalo KI.

The Gorontalo government allegedly violated Article 30, 31 and 32 of Law No. 14/2008 about Public Information Disclosure (UU KIP) for not conducting selection of KI members. The four articles are related to each other and must not be understood separately. The Gorontalo government only carried out Article 33 which is appointment of members, but failed to comply with the other articles.

Article 33 is not intended to restrict the term of KI members. “It was finally agreed the term of KI members is four years so that the term is not the same as presidential term which is five years,” wrote Annotation Team of UU KIP.

“For KI members that would like to be appointed again, in accordance with Article 30, 31 and 32 of UU KIP, they have to follow the recruitment process,” said the team.

Desiana Samosir, Coordinator of FOINI, said that in the last two years, there have been systematic efforts from Provincial KI incumbent members to extend their term without going through the selection process. The efforts came up in KI National Coordination Meeting on September 2014 I Mataram. One of the agreements read “Accepting Selection Process Guidelines and Information Commission Member Appointment with regards to inputs about operational guidelines of Incumbent Information Commission members.”

The phrase “with regards to inputs about operational guidelines of Incumbent Information Commission members” by the majority of Provincial KI members was interpreted as the rights of KI to be re-appointed without selection process.

“This is a bad precedent for the development of public information openness and threatens information services in provinces,” said Desi.

Therefore, FOINI took an action to fix this condition. FOINI previously sent a notification letter to Gorontalo Governor, DPRD Gorontalo and Central KI, asking all parties to play their respective role in the selection of Gorontalo KI.

FoINI Probes East Kalimantan Information Commission Candidates

Information Commission (KI) is a state auxiliary body that is established according to the mandate of Law No. 14/2008 about Public Information Disclosure (UU KIP) and is responsible in carrying out tasks stipulated in UU KIP, which are resolving information disputes and establishing policies or technical regulations of UU KIP implementation on standards of public information services and how to solve public information disputes.

In order for East Kalimantan to have a KI of integrity, IPC, as the secretariat of FOINI, JATAM KALTIM, WALHI KALTIM and POKJA 30 KALTIM saw the need to oversee the selection for KI by probing the track records of candidates for members of East Kalimantan KI.

The track record examination was conducted on 18 names announced by the selection team. The names are as follow:

The results of the examination were submitted to the selection team on Friday, April 15, 2016.

On April 15, 2016, East Kalimantan DPRD conducted fit and proper test and announced five top names as members of KI and five other names as reserves, they are:

  3. Lilik Lukitasari
  4. Muhammad Khaidir
  5. Muhammad Imron Rosyadi
  6. Rudi Taufana
  7. Habib
  8. Kukuh Tugiono

From the examination, one candidate chosen by the DPRD had some ethical issues when working at Public Body. FOINI lamented the selection team’s decision to choose a candidate with bad track records as it could result in bad influence in carrying out duties in the future. (Desiana Samosir)

Public Testing for Aceh Information Commission Members Period 2016-2020

IPC and FOINI network in Aceh, which is the Aceh Transparency Society (MaTA), saw the need to oversee the selection of the Information Commission in Aceh after conducting track record examination and public testing on prospective members of the Aceh Information Commission at the Syiah Kuala University on May 3, 2016.

The public testing involved three panelists, they were Dr. Taqwadin Husein (Head of Aceh Ombudsman Representative Office), Yaren Dinamika (Serambi Journalist) and Desiana Samosir (FOINI Secretariat).

The public testing was attended by:

  1. Afrizal Tjoetra
  2. Cut Hayatun
  3. Yusran
  4. Hamdani Nurdin
  5. Nurlaily
  6. Jehalim Bangun
  7. Tasmiati Emsa

Other three candidates, which are Arman Fauzi, Ety Rochaeti and Zulfikar Muhammad could not participate in the test.

Seven candidates of the Aceh Information Commission also signed Piagam Komitmen (Commitment Charter) which contains the following:

  1. Carrying out the mandates of Law No. 14/2008 about Public Information Disclosure and other related regulations to encourage transparency and anti-corruption
  2. Willing to build partnership with the government, society and other parties to realize the implementation of Law No. 14/2008 about Public Information Disclosure as well as other related regulations in Aceh Province.
  3. Submitting official wealth reports (LHKPN) regularly as stipulated in the law.
  4. Upholding code of ethics in carrying out duties as commissioner of Aceh Information Commission for the period of 2016-2020 as well as conducting regular evaluation.
  5. Willing to relinquish membership and position in other public bodies after being appointed as Information Commission member.
  6. Willing to work full-time as mandated by the law and other regulations.
  7. Willing to resign from Aceh Information Commission if proven to have violated the law in the future.

FOINI will give the results of the public testing and the signed Commitment Charter to Commission I of DPR in Aceh so that it can be used as consideration to choose the best candidate. (DA)

FoINI Urges North Kalimantan Government to Form Information Commission

Up until April 2016, the North Kalimantan Province has not established Information Commission. The FOINI Coalition sees that it is urgent for the provincial government to establish the commission in six regions. In order to achieve that, FOINI has done the following:

  1. Urging OGI National Secretariat to include a target of 100% in establishing the Provincial Information Commission in 2016.
  2. Urging the Information Commission to keep encouraging the forming of Provincial Information Commission in 2016.
  3. Overseeing the forming of Information Commission in six regions in cooperation with FOINI network in regions.

In the public discussion held on Wednesday, April 20, 2016, representatives from the government, universities, civil societies, the Regional Legislative Council (DPRD) and the media in North Kalimantan seemed to have little understanding about the Public information Disclosure Law (UU KIP). Most participants still questioned the need to form the Information Commission.

However, after gaining explanation about the importance of UU KIP, it was agreed that the Information Commission plays an important role in securing human rights.

In the discussion, Nurhayati (Chair of Commission I of North Kalimantan DPRD) da Suriansyah (Assistant of the North Kalimantan Government) stated their commitment to form a selection team so that by December 2016, North Kalimantan has established the Information Commission. Regarding the formation of Information and Documentation Managing Officer (PPID), Suriansyah said it was being reviewed by the Legal Bureau of the North Kalimantan Province. (Desiana Samosir).

Up until April 2016, the Southeast Sulawesi Province has not established Information Commission. The FOINI Coalition sees that it is urgent for the provincial government to establish the commission in six regions. In order to achieve that, FOINI has done the following:

  1. Urging OGI National Secretariat to include a target of 100% in establishing the Provincial Information Commission in 2016.
  2. Urging the Information Commission to keep encouraging the forming of Provincial Information Commission in 2016.
  3. Overseeing the forming of Information Commission in six regions in cooperation with FOINI network in regions.

On April 12, 2016, in a discussion held at the Southeast Sulawesi Governor Office, it was agreed that the forming of Southeast Sulawesi Information Commission must be carried out immediately. The meeting resulted in the appointment of members of Information Commission Selection Team that represent the government, the people and the Central Information Commission.

FOINI, through PUSPAHAM network in Southeast Sulawesi, stated its readiness to help the Southeast Sulawesi Information Commission.

Air Force Information Service Department Held Freedom of Information Socialization

Bangka Belitung, Kebebasaninformasi.org –  Air Force Information Service Department (Dispenau) held socialization related to the Law No. 14 of 2008 on Freedom of Information Law (KIP) in Hanandjoeddin Airfield, Bangka Belitung Islands, on Monday (November 17th, 2014). The socialization has implemented by Team Safari of Direct Information (Pensung) Dispenau led by Lt. Col. Sus Ernest DJ Fambrene along with Lt. Col. Sus Sonaji Wibowo and Sergeant Hendra.

Lt. Col. Ernest DJ Fambrene Sus, the Chairman of Direct Information (Pensung) Team of Headquarters Air Force stated, the purpose of the direct lighting is to convey information that is current in order to improve the performance of members in the unit ranks of the Air Force and their extended family. Lt. Col. Sus Sonaji Wibowo added that he deliberately brought the material of socialization of Law No. 14 of 2008 on Freedom of Information and Social Media so that all the Air Force Soldiers share a common vision and perception as well as add insight and knowledge about openness and use of social media in the military unit, especially the Air Force.

Lieutenant Colonel Pnb Setiawan said in his speech, now the Air Force Information Service Department is having big influence on the image of the Air Force to face the public, both in peacetime and conflict. Moreover, now the era of globalization and information technology becomes the holder of an important role in the transformation of issues, opinions or news information.

Therefore, Lt. Col. Pnb Setiawan invited all members of H.AS Hanandjoeddin airfield in order to listen to the message that convey and can take knowledge from the team of Air Force Information Service Department Presentation.
