A number of civil societies sent a letter to the governor and local council of West Kalimantan to form the Information Commission immediately. Judith E Vitranilla, one of the letter sender hopes that the Governor of West Kalimantan can process immediately the formation of Information Commission which had been halted or starting again of the process of formation from the beginning.

The delivery of letter as procedural steps to remedy Citizen Lawsuit, when the Local Government remains unwilling to perform its obligations to form the Information Commission of West Kalimantan Province.

The attorney of resident who filed the notification, Syahri added, a citizen lawsuit is a legal procedure for citizens who feel the public rights are not fulfilled by the state. Within 60 days since the notification letter is received, then it will file Citizen Lawsuit through Pontianak District Court.

The delivery of notification letter was supported by Public Openness Coalition, a coalition that formed since 2010 focus in the process of escorting the forming of West Kalimantan Provincial Information Commission and consisting of more than 20 local civil society.

Achu from JARI Indonesia of West Borneo, one of the bearers organization said that they fully supports the efforts that has been made by residents of West Kalimantan, because with the presence of the Information Commission, then the right on information access will be more open so that also open the monitoring on state officials.

“The participation or community involvement does not mean without guarantee on public openness,” said Achus as reported by Antara.

In accordance with the mandate of Article 60 in conjunction with Article 30 paragraph (2) in conjunction with Article 32 of Law No. 14 of 2008 on Public Information (Freedom of Information Law), Governor and Local Council shall establish the Information Commission at the latest in 2010, or two years after the enactment of Freedom of Information Law.
