TRIBUNLAMPUNG.co.id –The Lampung Information Commission (KI) has ordered the Lampung Irrigation and Settlement Agency to publish information on budget execution document (DPA) and letters of accountability (SPI) of drinking water and wastewater development program and housing community empowerment program from 2010 to 2012 requested by local NGO Tiem 99.
The decision was taken after the trial verdict at Lampung KI office on Thursday. Representatives from the Irrigation and Settlement Agency were not present.
In the trial, the judge council granted plaintiff’s request and determined that all requested information must be provided.

The Garut District Government has sued one of their citizens to the Supreme Court after the government lost a trial at Bandung Administrative Court (PTUN)
The lawsuit arose after the Garut Revenue, Financial Management and Regional Asset Agency (DPPKAD) lost in a dispute at West Java information Commission against Donny Setiawan, 37. “This lawsuit is our rights in accordance with the law,” said DPPKAD’s lawyer Margiyanto on Monday, 11 November 2013.
In the verdict dated 19 September 2013, PTUN judges endorsed the Information Commission’s decision. The judges ordered DPPKAD to provide copies of financial transaction documents of BJB, BNI, BRI and Bank Mandiri accounts from 2009 to 2010.
The basis of the dispute is alleged excess budget transfer from the central government of Rp 60 billion for revenue-sharing in 2010. There was also deposit of Rp 200 million that was reported in budget realization.
The budget difference was found in three documents, which are BPK examination report, the Ministry of Finance report about revenue-sharing realization and report of transfer confirmation by Finance Minister.
According to Margiyanto, DPPKAD rejected PTUN decision because it is still non-binding. They also objected to reveal all financial transactions because they are confidential. “Budget use is already in accordance with the regulation. BPK didn’t even find irregularities,” he said.
He hoped the Supreme Court would grant the Garut government’s plea and asked the judges to declare that the bank accounts are confidential. “However, whatever the decision later, we will accept it,” said Margiyanto.
Donny said the lawsuit against him was exaggerated and used to cover up budget irregularities. In the dispute trial, Donny said he only asked for journals and daily financial daily record of DPPKAD, not banking transactions of DPPKAD.
“The local government has no intention to obey the law. This is their arrogance to keep stealing from the people,” he said.

BANDUNG – The budget execution list (DPA) from every government institution under the West Java Provincial Government is still difficult to access. DPA can be used as reference in overseeing regional budget use.
The difficult access to information does not comply with Law No. 14/2008 about public information openness (UU KIP). The law stipulates that there must be information and documentation management official (PPID) that can provide access as much as possible for the people.
So far, PPID has not been established in every regional government organization. As a result, information is still difficult to access. The West Java Government’s non-transparent attitude in budget use is deeply regrettable and can cause DPRD’s oversight function not optimal. Moreover, budget transparency has never been seen since the regional budget plan was made.
“The formulation of the regional budget was also overlapping. There was no clear separation between direct expenditure and indirect expenditure. A clearer reporting is in DPA, but the DPA could not be accessed,” said West Java DPRD member Deden Darmansyah.
Deden also said the personnel expenditure budget of Rp 477 billion was too large. “This is our chance to check what the budget would be spent on,” he said.
Deden worried that the excessive budget would be used carelessly. Moreover, from direct expenditure budget of Rp4.4 trillion proposed in the 2013 revised regional budget, only Rp1.5 trillion that benefited the people. Meanwhile, West Java Deputy Governor Deddy Mizwar urged DPRD to ratify the revised regional budget.
“I hope the revised budget will be ratified as soon as possible,” said Deddy.

JAKARTA, KOMPAS.com – Supreme Court secretary said there are still 81 courts that have not actively published their verdicts through the Supreme Court’s website. “Most of them are from big cities, such as Jakarta,” he said on Saturday (25/1/2014).
He further said around 89 percent of 819 courts have published their verdicts on the website.
According to Soeroso, in order to encourage courts to publish their verdicts, the Supreme Court will require courts to send their verdict files in soft copies, instead the usual hard copies.
Soeroso added that he would hold a meeting with court chiefs in Jakarta and West Java to provide guidance on publishing their verdicts.
The Supreme Court in late 2013 announced 98 courts that had not published their verdicts, with most of them were general and religious courts.
Meanwhile, military and state administration courts’ participation reached 100 percent.

Information dispute between NGO Working Group (Pokja) 30 and nine political parties was continued by East Kalimantan Information Commission (KI), but only five of nine political parties’ representatives were present.
The five political parties were Golkar Party, United Development Party (PPP), Prosperous Justice Party (PKS), National Mandate Party (PAN) and Prosperous Peace Party (PDS). The other four, consisting of the Indonesian Democratic Party of Struggle (PDIP), People’s Conscience (Hanura) Party, Democratic Party and Great Indonesia Movement Party (Gerindra), were not seen.
“I suspect those who were not present underestimated mediation trial. Article 52 of Public Information Openness Law stipulates that public bodies that do not provide public information can be criminalized,” said Pokja 30 secretary Ramlianur.
Based on Pokja 30’s research since 19 August 2013, the nine political parties in East Kalimantan DPRD refused to provide their financial reports. This caused Pokja 30 to file for information dispute at KI.
Besides that, the absence of the four parties precisely showed the public that they were not open. “They go against the law by not attending the trial. They should’ve come if they really do carry out the constitution mandate,” said Ramlianur.
Meanwhile, East Kalimantan KI chairman Jaidun said the trial would be postponed until 10 December as only four parties were present. “If they don’t come for the second time, we will make decision without their consideration,” said Jaidun.

12 political parties in Samarinda in 2013 received aid of Rp98 million from the government, based on information from Ridwan Tassa, assistant of social community secretariat at Samarinda City Government.
Tassa said every year, there are regulatory changes that political parties and the government should pay attention to, especially those that are related to steps that must be taken before aid is given.
Home Affairs Ministry’s financial expert staff Purwoto said political parties are obligated to submit reports on what the aid is spent on for accountability.
As public bodies, political parties must be transparent and accountable as they operate using public money. “Political parties must have cash books so that at the end of the year, any spending and income can be seen,” said Murwoto.
The classic problem is that political parties tend to be reluctant to submit financial reports as they think their funds cannot be compared with the funds managed by the government. However, it is not about the amount of funds. It is about how political parties are being transparent and accountable in using the public money as it is regulated in political parties law and public information openness law.
